Participation agreement

I, the undersigned, acting as the responsible adult – whether for myself or for the minor(s) I accompany – sign this agreement to participate in the recreational services provided by IMAGINARIUM KIDS S.R.L., Tax ID 52492380, J2025069086002, operating under the brand "Imaginariumkids" (hereinafter the "Operator") at the venue located at Silk District, Calea Chișinăului 22, Iași. I understand that access covers areas and equipment such as: multi-level obstacle courses; zip line; slides (including LED slides); ball pit; trampoline zone & basketball hoops; football pitch & basketball hoops; area adapted for young children; parents’ relaxation area; parties and workshops – collectively referred to below as the "Activities". By checking and signing, I confirm each of the following points:

1. Term 1. I am at least 18 years old and have full legal capacity to enter into this agreement on my own behalf, or I sign as a parent, legal guardian, or expressly authorised adult accompanying a minor under 18 at the Activities. When I sign on behalf of a minor who is not my biological or adopted child, I confirm that I have the prior consent of the parent / legal representative to assume this responsibility. Participation – mine and/or that of the minor(s) – is voluntary and without coercion.
2. Term 2. I have read the Operator’s internal rules, notices and information displayed at reception and published on the website, I understand their content and agree to comply with them throughout each visit. I undertake to review these rules again before any future visits, as they may change.
3. Term 3. I confirm that I have read and understood the General Rules of Imaginariumkids, as well as the Rules for participation in the use of equipment and activities, both available at reception and online. I agree to their full application and declare that I have explained the relevant provisions to the minor(s) in a manner appropriate to their age and understanding. I understand that any age, height, weight or time limit displayed on equipment is mandatory.
4. Term 4. Regarding health status and fitness to participate, I declare on my own responsibility that: (a) neither I nor the accompanied minor is under the influence of alcohol, psychoactive substances or any medications or substances that may affect concentration, coordination, balance, reaction time or safe participation in activities at Imaginariumkids; (b) I and/or the accompanied minor are physically and mentally fit to take part in recreational and play activities on the premises and I am not aware of any conditions, limitations, medical restrictions or other circumstances that could make participation unsafe or contraindicated; (c) where there is any doubt about my or the minor’s ability to participate safely in the activities, I undertake to obtain a doctor’s recommendation or clearance in advance and to follow their instructions; (d) I understand and accept that participation in recreational activities involves inherent risks of injury, including falls, impacts, sprains, scratches or other incidents typical of play activities, even when equipment is used properly and safety rules are followed; (e) I accept responsibility for informing Imaginariumkids staff of any restriction or condition that may affect safe participation by me or the minor and I understand that access may be refused or interrupted when there are reasonable safety grounds concerning the participant or other users of the facilities; (f) I declare that the information provided is true and complete and I accept full responsibility for consequences arising from omitting or providing inaccurate information that could affect safe participation.
5. Term 5. I undertake to follow instructions received from the Operator’s staff, whether in writing (signs, panels, video materials) or communicated verbally during the visit, including directions regarding course order, proper use of equipment and safety measures. I acknowledge that failure to comply with the rules, aggressive or risky behaviour, or refusal to accept corrections may lead to a warning and, if the situation persists, to termination of access without refund of the ticket / package purchased.
6. Term 6. I acknowledge that the Activities are dynamic and involve inherent risks – slips, impacts, sprains, fractures, and in extreme cases serious injury, disability or death – which cannot be completely eliminated even when all safety measures are observed. These risks increase when I or the minor overestimate physical ability or ignore the rules. I undertake to behave prudently and guide the minor accordingly, not to engage in dangerous manoeuvres and to use equipment exactly as intended. The Operator is liable only for damage caused by its own fault regarding the condition, maintenance and safe operation of the facilities; it is not liable for accidents caused by my negligence, that of the minor or third parties, nor for unforeseeable and unavoidable events. I will personally bear medical expenses and material losses arising from participation and am liable for damage caused to other visitors or equipment by me or by the minor in my care, with Imaginariumkids being fully exempt in such cases.
7. Term 7. I consent to Imaginariumkids capturing photo / video images during the Activities in which I and/or the minor may appear, for the following purposes: (i) supervision and safety on the premises; (ii) internal staff training; (iii) promotion of the Operator’s services. I expressly consent to the processing of my personal data and that of the minor, strictly for: managing participation, internal records, safety measures and promotional activities. Resulting images and materials may be published on the website https://imaginariumkids.ro and on official social media channels (Facebook, Instagram, TikTok, YouTube and associated Google pages), without financial or material consideration. 8. Term 8. This agreement takes effect from the date of signing and covers the current visit as well as future visits to the same location, as long as the declared information remains valid. I undertake to inform the Operator at the next visit if details have changed (for example, the list of accompanied minors, phone, e-mail) or if a health condition affecting participation has arisen. I may withdraw consent at any time by written request sent to contact@imaginariumkids.ro; withdrawal does not affect the lawfulness of processing carried out until that moment.
